1. About VitalCopy

VitalCopy (“we,” “us,” or “our”) is a private, third-party document processing service that assists individuals in obtaining official vital records — including birth, death, marriage, and divorce certificates — from the appropriate government agencies.

VitalCopy is not affiliated with, endorsed by, or operating on behalf of any federal, state, or local government agency.We are an independent service provider. Official vital records can also be obtained directly and at lower cost through your state’s vital records office.

2. Acceptance of Terms

By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, you may not use our services. We reserve the right to modify these terms at any time. Continued use of our services after any changes constitutes your acceptance of the new terms.

3. Our Services

VitalCopy provides the following services:

  • Collection and preparation of vital records applications on your behalf
  • Submission of completed applications to the appropriate state or county vital records agency
  • Tracking and status updates throughout the processing period
  • Delivery of official certified copies to your specified shipping address

Processing times are determined by the issuing government agency and may vary. VitalCopy cannot guarantee specific processing times or outcomes from government offices.

4. Eligibility & Authorized Requesters

You must be at least 18 years old to use our services. Vital records are restricted documents. By submitting an order, you represent and warrant that you are an authorized requester under applicable state law — typically:

  • The individual named on the record
  • A parent, legal guardian, or immediate family member
  • A legal representative (attorney, executor of estate)
  • A licensed funeral director (for death certificates)
  • Any other person with a direct and tangible interest as defined by state law

Providing false information to obtain vital records may constitute fraud under state and federal law. VitalCopy reserves the right to cancel any order where we have reasonable cause to believe eligibility requirements are not met.

5. Fees & Payment

Our total fee includes: (a) a service processing fee charged by VitalCopy, (b) the government-mandated state fee for the certified copy, and (c) applicable shipping charges. All fees are disclosed at checkout before payment is collected.

Payment is processed securely via Stripe. By providing your payment information, you authorize VitalCopy to charge the total amount shown at checkout. All transactions are encrypted and we do not store your full payment card details.

Government fees and shipping charges are non-refundable once your application has been submitted to the agency. See our Refund Policy for full details.

6. Accuracy of Information

You are solely responsible for the accuracy of all information submitted through our form. VitalCopy will prepare your application based on the information you provide. Errors, omissions, or incorrect information may result in delays, rejection by the issuing agency, or additional fees. VitalCopy is not responsible for rejections or delays caused by inaccurate information provided by the customer.

7. Identity Verification

Depending on the state and record type, we may require you to provide a copy of a valid government-issued photo ID and/or additional supporting documentation. Failure to provide required documents within 7 business days of your order may result in cancellation and a partial refund in accordance with our Refund Policy.

8. Limitation of Liability

VitalCopy acts as a processing intermediary only. We are not responsible for delays, rejections, errors, or other outcomes caused by government agencies. Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the order giving rise to the claim.

To the maximum extent permitted by law, VitalCopy shall not be liable for any indirect, incidental, special, or consequential damages, including lost time, lost profits, or inconvenience, even if advised of the possibility of such damages.

9. No Guarantee of Record Availability

VitalCopy cannot guarantee that a specific vital record exists, is available, or will be released by the issuing agency. Records older than the state’s access restriction period, records for which you lack eligibility, or records that were never filed may not be obtainable. In such cases, applicable refund terms will apply.

10. Governing Law

These Terms & Conditions are governed by applicable United States federal and state law. Any disputes arising from your use of our services shall be resolved through binding arbitration or small claims court, at our election, and you waive the right to participate in any class action lawsuit against VitalCopy.
